This Refund Policy outlines our strict guidelines regarding refunds, cancellations, and financial transactions. All transactions are governed by Nicaraguan law and are designed to protect the interests of Corn Island Realty, property owners, and the integrity of our operations. By engaging with our services, inquiring about properties (such as Bamboo Blue House, Moma Lola’s, or Blue House on Big Corn Island), making bookings, or entering into agreements, you acknowledge and agree to this policy. If you do not agree, please do not proceed with any transaction.
1. General Principles
All payments, deposits, fees, and charges made to Corn Island Realty are non-refundable unless explicitly stated otherwise in a separate written agreement signed by an authorized representative of Corn Island Realty. We do not offer refunds for changes in personal circumstances, market conditions, weather events (including those referenced in our weather widgets), travel disruptions, or dissatisfaction with properties or services. Refunds, if any, are at our sole discretion and may be subject to administrative fees, deductions, or complete denial.
2. Deposits and Reservations
For property rentals (e.g., nightly rates such as $100 per night for Moma Lola’s or similar listings on Big Corn Island and Little Corn Island), any deposit or reservation fee is fully non-refundable. This includes initial payments to secure availability, which are forfeited upon cancellation for any reason. Deposits for property sales or purchases (e.g., $375,000 listings like Bamboo Blue House) are non-refundable and serve as earnest money to hold the property off the market. In the event of buyer withdrawal, the deposit is retained by Corn Island Realty as liquidated damages to cover administrative costs, lost opportunities, and relisting expenses. No refunds will be issued for provisioning services (e.g., stocking rentals with supplies) once ordered, as these are customized and perishable.
3. Cancellations and Modifications
Rental bookings may be canceled only with written notice at least 60 days prior to the check-in date, and even then, only a partial credit (not exceeding 50% of the paid amount, minus fees) may be applied toward a future booking at our discretion. Cancellations within 60 days result in full forfeiture of all payments. For property management services, fees are non-refundable once services commence. Early termination by the client does not entitle them to any refund, and outstanding balances remain due. Modifications to bookings or agreements (e.g., changing dates, properties, or services) are subject to availability and may incur additional non-refundable fees. No refunds are provided for downgrades or reductions in services.
4. Property Sales and Transactions
All property sales are final upon execution of the purchase agreement under Nicaraguan law. No refunds are available for buyer’s remorse, title issues discovered post-closing (users are advised to conduct independent due diligence), or fluctuations in property values. Any escrow funds or payments are released only upon successful closing; failed transactions due to buyer fault result in forfeiture of all funds to Corn Island Realty.
5. Force Majeure and External Factors
Corn Island Realty is not liable for refunds in cases of force majeure, including but not limited to natural disasters, political unrest, pandemics, airline cancellations, or local events in the Corn Islands (e.g., disruptions at spots like Sea Side Grill or The Buccaneer). We strongly recommend travel insurance to cover such risks, as no refunds or credits will be issued.
6. Payment Processing and Fees
All payments are processed securely, but any disputes must be raised within 7 days of the transaction. Refunds, if approved in exceptional circumstances, will be reduced by processing fees (up to 10%), currency conversion costs, and any applicable taxes. Refunds are issued in the original payment method and may take up to 90 days to process.
7. Disputes and Claims
Any claims for refunds must be submitted in writing to info@cornislandrealty.com within 14 days of the incident or transaction, accompanied by detailed evidence. Corn Island Realty reserves the right to investigate and deny claims without explanation. By agreeing to this policy, you waive any right to chargebacks or disputes through payment providers, and such actions may result in additional collection fees or legal action.
8. Limitation of Liability
Corn Island Realty, its agents, and affiliates shall not be liable for any financial losses, including non-refundable payments, arising from adherence to this policy. This policy supersedes any verbal representations or prior communications.
9. Changes to This Policy
We may update this Refund Policy at any time to reflect changes in our practices or legal requirements. The updated policy will be posted on cornislandrealty.com with the new “Last Updated” date. Continued engagement with our services after changes constitutes your acceptance.
